On Feb. 2, United Kingdom’s News Of The World published a picture of the 14-time Olympic gold medalist using a bong to smoke pot. The picture was taken at a party in Columbia back in November when Phelps was there for a visit. and Michael Phelps, Olympic swimming octo-champion, has admitted he has smoked marijuana.

Apparently, the potential charges went up in smoke. Or did they?

Leon Lott, Richland County Sheriff’s Office, said in a statement that there was not enough physical evidence to charge Michael Phelps with a crime. The Sheriff admitted that even if he could have found enough evidence, he would not have been able to force Phelps to return to South Carolina to face what would have amounted to a misdemeanor crime. But, then, as he stated, Michael Phelps has not once admitted to smoking marijuana.

The over-zealousness with which the Richland County Sheriff’s Office pursued the Michael Phelps bong shot “drug” case has been well documented, satirized, lampooned, and ridiculed. Sheriff Lott stated that he knew that when the bong picture surfaced on the internet (via tabloid News of the World on February 1), he had to choose between investigating or letting it go, either choice being subject to ridicule. He said he chose what was “right.”

Despite his bong incident, Michael Phelps is in good spirits at the Meadowbrook Athletic Club in Baltimore, Maryland on Thursday (February 5).

The 23-year-old Olympic champion told the Balitmore Sun that he might pass on the 2012 Olympics, saying, “This is a decision of mine that I’m not going to make today and I’m not going to make tomorrow. It’s going to require a lot of time and energy and a lot of thinking for myself – but also talking to [coach Bob Bowman] and talking to my family and just deciding what I want to do.”

Phelps continued, “But I’m not going to let anything stand in my way. If I decide to walk away, I’ll decide to walk away on my own terms. If it’s now, if it’s four years, who knows. But it is something I need to think about and decide what I want to do.”

The CEO of the U.S. Olympic Committee said Wednesday he’d like to have a face-to-face meeting with Phelps, and spokesman Darryl Seibel said the federation was sending the Olympic star a letter offering its assistance. “We at the USOC, as we said in an earlier statement, are exceptionally disappointed in him, as he is in himself,” Jim Scherr said during a conference call that was set to preview the 2010 Winter Olympics.

Michael Phelps celebrates victory in the Men’s 4x 100m Freestyle Final during the 13th FINA World Championships at the Stadio del Nuoto on Sunday (July 26) in Rome, Italy.

“When we come into a meet we have a goal to win all three relays, and I think this is a perfect way to end day one,” the 24-year-old swimming champ said. “Relays are raced as a team, and I think all four guys swam a great race.” (The other three swimmers: Ryan Lochte, Matthew Grevers and Nathan Adrian.)
